WHAT IS THE INVENTION ?

Inventions are innovations that provide a technical solution to a problem. These innovations may be a completely new machine, product, chemical compound or method. Or it may be an improvement on a known machine, product or method.

 

How Do We Know If An Invention Is New?

To find out whether your invention is new, you can do research on websites that you can use free of charge. This way, you will not waste money, effort and time on an invention that has already been found.

 

WHAT IS A PATENT?

These are monopoly rights granted to the patent owner for a limited time and place in order to prevent the invention from being produced, sold, used or imported by third parties without permission. The document showing that the use of this right belongs to the applicant is called Patent Certificate.

Patents are granted to inventions in all fields of technology, provided that they are new, involve an inventive step and are industrially applicable.

 

PATENTABILITY CRITERIA

Innovation: It means that the invention is not included in the known state of the art, that is, it differs from the currently disclosed technical information.

Invention Step: The invention is made by a person who is an expert in the technical field to which it is related.

It means that it is of a nature that cannot be clearly deduced from its situation.

Industrial Applicability: It means that the invention can be produced or used in any branch of industry.

 

Inventions for which a patent application will be made must not be new or have not been published in written or oral form in any accessible media worldwide. At this point, before taking steps to implement the ideas, "Has anyone in the world thought of this invention or something similar before?" It is important and a priority to conduct a comprehensive patent search to answer the question.

 

The following subjects and activities that are not considered inventions by the Industrial Property Law are excluded from patentability.

·                    Discoveries, scientific theories and mathematical methods

·                    Plans, rules and methods for mental activities, business activities or games

·                    Computer programs

·                    Aesthetic products, literary and artistic works and scientific works

·                    presentation of information

·                    Again, although they are inventions in the Industrial Property Law, the following subjects are excluded from patentability.

·                    Inventions that are against public order or general morality

·                    Essentially biological processes for plant or animal production with plant varieties or animal breeds, excluding microbiological processes or products obtained as a result of these processes.

·                    All treatment methods, including diagnostic methods and surgical methods to be applied to the human or animal body.

·                    The human body at various stages of its formation and development and the mere discovery of one of the elements of the human body, including a gene sequence or partial gene sequence.

·                    Human cloning processes, processes of changing the genetic identity of the human germ line, use of human embryos for industrial or commercial purposes, genetic identity changing processes that may cause suffering to animals without providing any significant medical benefit to humans or animals, and animals obtained as a result of these processes.

 

HOW LONG IS THE PATENT PROTECTION DURATION?

Since the patent certificate is issued based on an examination report showing whether the applied product is new, industrially applicable and meets the inventive step criteria, a stronger and longer protection is obtained. The patent certificate provides protection for 20 years from the date of application and this period cannot be extended.
